Welcome to MyHelprAI LLC (“MyHelprAI,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, software, services, and related tools (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Overview

MyHelprAI provides AI-powered receptionist and automation services for businesses, including call handling, scheduling, and messaging tools. Our Services are intended for commercial use by legitimate businesses and are subject to these Terms and our Privacy Policy.

2. Account and Access

  • You must be at least 18 years old and authorized to represent your business to use the Services.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or unlawful purposes.

3. Fees, Billing, and Refunds

  • All paid plans require payment of an initial setup fee followed by recurring monthly billing.
  • Billing begins seven (7) days after your setup fee is paid unless otherwise stated in writing.
  • All fees are non-refundable. By completing payment, you acknowledge and agree that no refunds will be issued for any reason, including early cancellation.
  • We reserve the right to adjust pricing at any time with prior notice for renewals or future billing cycles.

4. Acceptable Use

  • You may not use the Services to transmit spam, malicious code, or unlawful content.
  • You may not reverse-engineer, copy, resell, or misuse any part of the MyHelprAI system or branding.
  • You agree to comply with all applicable local, state, and federal laws, including telemarketing and data privacy regulations.

5. AI Disclaimer

MyHelprAI’s automated systems use artificial intelligence and natural language processing to answer calls, schedule appointments, and assist with customer inquiries. While we aim for high accuracy, AI responses are generated automatically and may not always reflect human judgment or be error-free. AI responses are for informational purposes only and should not be considered legal, medical, financial, or professional advice. You are solely responsible for reviewing and verifying all information or bookings made through the AI assistant.

6. Intellectual Property

All content, code, branding, logos, and materials within MyHelprAI Services are the exclusive property of MyHelprAI LLC and are protected by copyright, trademark, and other laws. You may not copy, reproduce, or distribute any materials without written permission.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. By using MyHelprAI, you consent to our collection and processing of information as described there.

8. Service Availability

We make reasonable efforts to maintain uptime but do not guarantee uninterrupted or error-free operation. Maintenance, updates, or third-party provider issues (such as LeadConnector, Google Cloud, or Stripe) may cause temporary downtime.

9. Limitation of Liability

To the maximum extent permitted by law, MyHelprAI LLC and its affiliates, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of data, revenue, profits, or business opportunities.

10. Indemnification

You agree to indemnify and hold harmless MyHelprAI LLC from any claims, damages, or expenses arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights.

11. Termination

We may suspend or terminate your access at any time for any violation of these Terms or for conduct that may harm our reputation, systems, or other customers. Upon termination, your right to use the Services ceases immediately.

12. Modifications

We may modify these Terms at any time. Updated Terms will be posted at https://www.myhelpr.ai/terms-of-service with a new “Last Updated” date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed under the laws of the State of Iowa, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in Polk County, Iowa.
